The Massachusetts Department of Health has conspired with Google to secretly install the COVID-19 tracking application on devices of more than 1 million Android users without their knowledge and without permission. This was stated by the New Civil Liberties Alliance in its class action lawsuit filed this week.
New Civil Liberties Alliance ( NCLA ) – nonprofit organization for the protection of civil rights.
According to a lawsuit, the application provided the Ministry of Health, Google, application developers and others with access to:
Wireless IP Addresses;
phone numbers;
contacts;
email;
personal information;
location;
user movement.
The lawsuit claims that if the user deletes the COVID-19 tracker, the Ministry of Health will reinstall it on devices.
« The Ministry of Health has installed spyware that deliberately tracks movements and personal contacts on more than 1 million devices without the permission and knowledge of their owners », — is said in the lawsuit . « As far as we know, spyware is still installed on most devices ».
Plaintiffs ask the court to stop the secret installation of the application and oblige Google to delete the application in cases where the owner did not give permission to download the tracker.
They also noted that the secret installation of the tracking application violates state and federal protection measures. Moreover, it violates the privacy of Android users and Massachusetts Computer Crime Laws
The lawsuit requires the health agency to pay all expenses and attorney fees, as well as nominal damage in the amount of $ 1.
A spokesman for the Massachusetts Department of Public Health said the department did not receive a lawsuit and did not comment on the upcoming lawsuit. Google also did not respond to a request for comments.
